Montana motorcyclist killed when hit by van

With the weather getting warmer and spring time finally here there are many more motorcycles on the road. It is important for other motorists to make sure motorcycles have the same consideration as other vehicles. Motorcycle awareness is important in avoiding a motorcycle crash.

In Bozeman a van hit a motorcycle on Norris Road on the afternoon of May 5, 2013. The Motorcyclist was new to Bozeman and was an employee of Montana State University. The motorcyclist was riding in a group of four other motorcycles at the time of the accident. At the scene he was given CPR but died before the sheriff arrived. The motorcycle rider was wearing a helmet.

Helmet no solution for concussions says product liability claim

It sounded like the solution to all parents and coaches fears; a helmet that prevents concussions. A helmet company promised fewer concussions, but was that a true statement or was this a dangerous product because of a lack of adequate warning?

Riddell is a corporation that makes athletic helmets as well as other sports equipment who suggested that they had the answer to the numerous concussions that have been plaguing many sports. Riddell published on their packaging that their new helmet was proven to prevent dangerous concussions. Many people, including some professional athletes, bought the helmets under the impression that the helmet would make them safer from concussions. It turns out the helmets were not any safer and recently were found to have insufficient warnings on their packages. Two recent product liability lawsuits, one from the parents of an injured teenage child and another from players in the NFL in a class action, revealed that Riddell knew the helmets were not concussion proof. Despite the issues, the company continued to make the safety claim on product packaging.

School bus involved in auto accident

Each day Montana children take busses to their schools and to school-sponsored events. While most kids arrive safely at their destinations, the threat of auto accidents is always possible when their busses take to the roadways. The potential for injuries when high occupancy vehicles like busses encounter collisions presents serious dangers to the children involved.

A recent school bus incident demonstrates how quickly dangerous situations can develop. After waiting for all of its young passengers to disembark, a Glacier High School bus driver disengaged the brakes in order to move the vehicle to a different parking spot. When another vehicle took the new spot, the bus driver got off of the bus without reengaging the brakes. The empty school bus then rolled away with no driver at the wheel and crashed into several parked cars.

Montana veterans home sued for medical malpractice

It is generally understood that doctors must follow a certain standard of care when treating patients. This standard of care model is also carried over to health professionals and doctors who deal with residents and patients of nursing home or assisted care facilities. While many of these residents may not have pressing medical needs, they are often enlisted into the facility because the health care needs exceeds what a family member can provide at home.

If the professionals in a nursing home, or the like, fail to meet this standard of care, then injured victims can bring a medical malpractice suit for nursing home or doctor negligence. A woman recently brought a lawsuit against the Montana Veterans Home for the death of her grandfather. In addition to other charges related to the incident, the lawsuit alleges medical and nursing malpractice.

Montana man on trial for fatal car-pedestrian accident

Billings residents may have read about the recent trial of a Montana man who faces criminal charges related to a traffic accident that killed an 80-year-old pedestrian. But a criminal trial is just part of the legal action that may follow a fatal car accident.

Police said the driver was drunk when he struck the elderly man as he tried to cross a street on March 3. The man died in a hospital almost three weeks later. The driver's blood alcohol level was about 0.12, over the legal limit, according to court papers. He pleaded not guilty to charges of vehicular homicide.

Car accident in Missoula sends man to the hospital

As the weather gets warmer, the roads of Montana begin fill up with motorcycles. This increases the risk of accidents that can occur between motorcyclists, cars and trucks. Unfortunately, motorcycle drivers can be particularly vulnerable, and can often suffer serious, even catastrophic, injuries while driving on the roads of Montana.

Recently, a motorcycle was struck by a car at the intersection of North Higgens and Front Street in downtown Missoula. Although the exact details of how this car accident occurred are not yet available, the motorcycle driver was taken to the hospital following the crash. The condition of the motorcyclist is not known at this time, but, fortunately for the driver, the injuries did not appear to be serious according to the initial reports.

Company faces product liability issues from transparent pants

Montana residents often engage in yoga in order to relax, but they are likely to be disappointed after learning that some of their pants may be see-through. Fitness apparel company Lululemon recently had to recall 17 percent of its black yoga pants after a supplier from Taiwan made a defective batch with see-through material. The product liability issue could cause negative publicity for the Canadian company.

The issue involves the pants' fabric, which is made from a blend of lycra and nylon. The pants appear solid while worn in a standing position, but when people bend over, others can easily see through the garments. If the person wearing these pants is not sporting any underwear, then others can potentially see private body parts, which could cause embarrassment for yoga participants and business problems for exercise studio owners.

Head on collision near Helena leaves three people injured

Montana drivers know that icy and snowy weather can make the roads extremely hazardous. That is why all individuals must exercise extreme caution when confronted with icy roads and blinding snowfalls. Recently, a car accident that occurred during extreme weather conditions was reported at the top of MacDonald Pass in Helena.

According to the report, a yellow Pontiac crashed into a beige colored car in a head on collision. The beige car held two passengers and a 1-year-old child. The yellow Pontiac held a mother and her daughter. Although the reports indicate that the roads were virtually covered in ice and the winds were blowing large amounts of snow around, the mother, who was driving the yellow Pontiac, was issued a citation for careless driving. The police presumably believed that she was not driving in an appropriate manner for the hazardous weather conditions that she was facing.

Two injured in Montana car accident

Montana residents know that driving can be dangerous business. Unfortunately, vehicle accidents occur every day on the streets of Billings. In fact, recently, there was a car accident on Brooks Street in Missoula. According to reports, the rear-end collision involved two vehicles. It is not clear, but there is a possibility that another car was also involved in the accident.

The reports indicate that there were two individuals who were transported to the hospital after the accident. One of the individuals had to be carried away on a back board. He may have suffered an injury to his back or neck. The injuries were reported to be non-life threatening.
